Just an opinion.
The issue before the court is not the details of the NTA it is the failure of Quaser/HG to include AGS in the NTA. The 2nd NTA submitted by Q was modified not to include the Beverley lease but still didnt include AGS as a party to the agreement,so this was rejected by the Mining Register. So either the parties sort out an NTA via mediation or go to trial. If AGS win the trial case which is highly likely there will still be the requirement to sort out an NTA to suit both parties which may also require mediation.
May as well mediate now and get on with it.
