If he has 10 HIN's and they aren't all in different names (and I suspect they aren't, while I can trade in my own name, a company or get my wife to buy it's hard to get to 10 legitimate separate entities for most) then he is not only in breach of the offer term (not technically but actually in breach) but in breach of the ASIC order under which the offer is made. I've heard a rumour that ASIC has got much more interested in this and are pushing companies to enforce more strenuously and even denying participants any shares if they are shown to breach.
The lever that ASIC has is they can in theory can the whole SPP, not that I have ever seen them enforce that!
