The statement from the ATO seems to indicate that they are unhappy with the way spreadbetting on shares is being marketed - "a tax-free alternative to trading shares". If the companies had said "tax free gambling on the stock market" there probably wouldn't have been a problem.
But the delay in a ruling from the ATO suggests they are not happy but don't have the legislation in place to enforce what they would like to crack down on.
