VMC vs SPX Court Meeting Friday 22nd Nov 2019
My broker had an observer attend the hearing Friday.
Mathew (Sirloin?) Hogan actually didn’t show up but their Chairman Peter Hawkins did. Alex Hewlett attended on behalf of SPX and Adams/Bosio also in attendance
As expected, mostly procedural.
SPX pushing for very quick court case and Venus using numerous excuses to try and stall.
SPX QC presented as most professional, VMC QC seemed more theatrical and not totally across the detail (e.g. at what point of time will VMC actually be arguing their line of damage).
The judge seemed to understand all those games being played and conscious 2400 minority SPX shareholders are being very adversely effected by the uncertainty surrounding such a writ.
Now likely the court case may even be split, with initial determination deciding whether any guilt, second case would determine extent of damages (if VMC were to succeed)
The topic of a likely SPX shareholder class action (post court determination) was also tabled in the hearing [taken up by - Slater & Gordon]

My broker is hoping that ASIC attends the court stouch between Venus and Spectrum
integrity, personal character and past professional credibility of all key players will need to be tested . Some interesting shite on past behaviour and deeds may even come floating up to the surface
in such a circumstance, you wouldn’t want to have made any nasty enemies of your past staff, business partners, former wives, competitors, clients, etc .... as they know where the bodies are buried.

So........................the ONLY info we have had about the Court Meeting to date.
Looks good so far for SPX. Having Slater & Gordon for the class action lends weight to SPX defence.
VMC seem to be have issues? struggling?
