Section 5 to 9 at the end particularly relate to lithium mining:
[5] In addition, the Ministry of Industry and Trade itself drew attention to the significant economic and legal risks of the project in analyzing the possibilities of the state to participate in the possible extraction and processing of lithium in the Czech Republic, which it worked out in cooperation with the state enterprise DIAMO in fulfillment of the tasks of Government Resolution no. 713, dated 11 October 2017. The analysis highlights the need to secure all necessary permits and to launch a massive state investment of the order of billions of crowns into the preparation of mining and processing of minerals. At the same time, the analysis points out that the state would at the same time have to take all risks associated with it. As one of the legal problems, the analysis mentions the area of prohibited state aid in the situation if the state would provide funds directly from the budget for this business activity. [6] However, the exploration and extraction process takes place in competition with deposits located in the territory of other states, for example, if, for example, in the case of lithium mining, it is clear that waiting for the mining project at the Cínovec site may lead to the loss of a certain competitive advantage of the Czech Republic and waste opportunities in the development of the downstream processing industry (information on the state of preparation for lithium mining in Germany see eg - available on www, available >>> here.) [8] Similarly, Article 2 (2) of the Charter of Fundamental Rights and Freedoms, according to which state power can only be exercised in cases and within the limits prescribed by law in a manner that the law provides. [9] The modern state is to function as a highly professional and rational institution that relies on professional and repoliticised bureaucracy.
