    Hy Monkey,

    That really goes to show how much you really know about things. Very very little indeed, let me tell you.

    For, even today for anyone to enter anyone's property is not as easy as it used to be up to 20 or 30 years ago.

    The only one that has right of entry to anyone's lands is the Communication Industries such as Telstra, Optus and the likes, and of course the NBN. But even for them before they enter your land, they have to negotiate an acceptable price/compensation with you. I can speak from personal experience here, while I am now making a mint out of it on a yearly basis, tied up of course with yearly percentage increases.
    So, all in all, yes they can come in, but they have to be prepared to pay/meet your price/criteria. You can make it so hard for them, that they will wish that they never heard of you. The point is, that they've approached you because you have the lands and the position that suit their purposes, and a such you can wield the power you wish in return to extract the best return for you.

    Then, when the job has been completed, they even have to make sure To Your Satisfaction, that any reparation work has to be completed before they are released and cleared from the work they have performed on your lands, plus any damages for crops, etc. As for what reparation work to be performed at your satisfaction means, I will leave that up to you to figure out.

    As for the Local Councils, what can I say. Maybe you should go and read the NEW ACT properly and you would find out that before they do anything they have to pay you full compensation. As to what Full Compensation mean, maybe you should ask a Specialist Lawyer what that mean.
    And Government Departments aren't faring much better and in the same way. You can also refuse entry to Local Council and their staff, while, and even then there is room for arguments, they will write to you that they reserve the right to enter your lands in Emergency cases only.
    They can start resumption of your lands if they wish, but how long is a piece of string, lol. For, for it to succeed, and at what price, you can write a book on it.

    Finally, If you were to put a sign on your gate that clearly states the Case number where a High Court Decision found in favour of the Landholder some time ago, than no one is allowed to enter.

    I hear what you are saying that the Farmer does not own what is below a certain level of his lands, and without making any proper research, at this point in time I can't argue with that. BUT, You would still have to come into my lands before getting to what is underneath it.

    So, maybe you should revisit those legislation and find out what is applicable in these days, before you make these baseless Statements. As you said you have been living in Cambodia/Asia for quite sometime now, and you may have missed these things.

    But let me assure you that things aren't as easy for them (Governemnt Departments and others) as they used to be. As a matter of fact, I'll go as far as saying that they aren't any better off, than anyone else now.
