And the lie can be intentional and accidental substp. For eg, the 'value' quoted here that Asbury purportedly paid. Is that the 'value' per tonne? Import duty inclusive? Shipping costs inclusive? Insurance inclusive? See - 'declared value' does not mean price PAID.
These are the types of 'excuses' defendants have used in those google cases i mentioned above where companies were found guilty of misrepresenting.
There are also examples where the descriptions were wrong. I have found examples where they reported that they were moving pencil grade graphites when really they moving nuclear grade. That 'lie' was a little intentional imo - given that nuclear grade is subject to all those anti nuke proliferation headaches.
But like I said - sometimes the misrepresent is accidental. Like here where Portexaminer records state that Stratmin shipped 'Artificial Graphite' to Asbury. HTS 38011000. Numbers are very important. That number specifically relates to shipments of synthetic graphites not natural substp.
