i would only be guessing at answers to both questions but I don't see CUS being a bg-enough player in the market to worry the ACCC ( don't forget there are around 16 small independant players out there)
While CUS balance sheet may be able to support a buy-out, I see CUS as the more likely target for a T/O. At, say $3.90 a share, I can see many, many s/holders jumping off while $3.90 still being cheap (potentially)
All this in mho.
Balance sheets T/O's etc are not my forte but I know a little about the industry from a ground-level viewpoint.
