    the Robodebt inquiry continues with leading legal minds under scrutiny.

    today former Chief Counsel of DHS, Annette Musolino, was asked about: -

    For the first time, the commission was shown a brief sent to the then government services minister in November 2019, summarising advice from the solicitor-general that found the scheme was unlawful.

    The brief, which was signed by Mr Robert, said: "The continued administration of the program in its current form may amount to misfeasance in public office."

    with the question that Robert's continue with the Robodebt would amount to misfeasance. the definition of which includes: -

    The second circumstance is where the defendant engaged in the conduct with either knowledge of, or reckless indifference about, two things; first, that their conduct was invalid, unauthorised or beyond power; and second, that their conduct would probably cause injury or damage to the plaintiff. The public officer’s conduct in that circumstance involves bad faith because they acted despite the fact that they did not believe that their conduct was lawful …
