If the Judicial review process declares the Ministers actions as invalid, then RIO will have no other grounds available to them to lodge an objection.
Their only available argument is "public interest"...this is because by the letter of the law their case does not exist in any other form.
By choosing the "public interest" line of defense, RIO knew they could rely on the Minister to come-to-the-party on their behalf.
Do people not realise that...regardless of CAZ's orignial submission, nor how legally water tight their argument may have been, by law or intent, that the Minister was always going to award the tenement to RIO?
The plain and simple fact he appears to have acted outside his "powers of discretion" is in itself, evidence that the entire decison process was more or less pre-determined...lol...perhaps in a London RIO office?
Anyway...the bottom line is that without the "public interest" argument, RIO do not have a case...period...and if the opinion of the highly respected Wayne Martin QC (Chief Justice WA) is worth anything, it would appear that they do not!
Bring it on!
In the meantime...CAZ will be a traders wet-dream, whilst also retaining some long term hold appeal.
