I would have thought with Unity talking about giving capital back to shareholders then the need to issue additional shares for additional capital is not there and given the growth profile of Dargues if it grows as management have suggested then 3 cent shares would be dilutionary to other shareholders and contrary to Unity's stated intention of tightening the share register by buying shares back from shareholders including a possible scheme for buying out shareholders with unmarketable parcels.

3 cents is 20% above current price and above cash backing. Plus their should be penalites for Liongold not delivering as it has made UML's business more difficult due to not having the cash at the time.
So there is a upside in pursuing this.
At the same time lawyers generally costs everyone involved so management should take a serious look into the risk / reward for pursing these funds before proceeding.
