No, the land has reverted to customary land. The registered trustees of the Perpetual Estate land have been remover from the register, and the land is no longer Perpetual Estate. Which means that:
400.
Section 241(1) provides that, subject to any contrary provision in the Act, no person other than a Solomon Islander may hold or enjoy any interest of whatsoever nature in over or affecting customary land. Subsection (3) further provides that every contract, agreement or arrangement made or entered into “shall, so far as it has or purports to have the purpose or effect of in any way, directly or indirectly, defeating, evading or preventing the operation of subsection (1) , be utterly void and of no effect”. The subsection continues to provide that the Commissioner of Lands has the discretion to institute proceedings in the High Court for a declaration that any such alleged contract, agreement or arrangement is void and of no effect.
So the process needs to be gone through again, properly, and the agreed trustees properly registered for the land to become Perpetual Estate. Then leases and whatnots can be executed, and registered.
