Surething, I think your boys are wrong, my reseacrh and my man at the DoiR has confirmed that the Mininster does have the authority to overrule on an EL.

The relevant part of the Section 111(a) is Paragraphs 1 (b) & (c) which deal with the Minister's right to "refuse an application for a MINING TENEMENT ... on reasonable grounds in the public interest"

On the face of it is looks like it may not refer to an Exploration Licence however when you read the definitions in the act you will find:

MINING TENEMENT - means a prospecting licence, exploration licence, retention licence, mining lease, general purpose lease or a miscellaneous licence granted or acquired under this Act or by virtue of the repealed Act; and includes the specified piece of land in respect of which the mining tenement is so granted or acquired;
