I presume all HCers are aware of the "NO CASE TO ANSWER" opinion, following Rio initial submission - see the following extract from Cazaly's ASX announcement of 9 November 2005:
"Cazaly has taken legal advice from Wayne Martin QC about the content of Rio Tinto Limited's (Rio) submission.
Based on that advice, Cazaly has formed the view that the matters that Rio have raised cannot be taken into account by the Minister for State Development in making his decision and that Cazaly has no case to answer in relation to Rio's application under section 111A of the Mining Act of 1978."
I presume all HCers are aware of the "NO CASE TO ANSWER"...
