Unfortunately some years back, I got tied up (legal) in around 3 separated potential property deals, that in total, it was over a period of 10yrs.
All because of stupid solicitors, slightest errors in a contract and thieves.
A case can be one or lost, on the likes of a few words or a dime.
Also, if any verbal discussions can be proven, like dated diaries etc, pre a contract, they form part of the contract, hence a case can drag on forever.
The sad part though, within the Big picture, it is clear which one is at fault, but it can swing in their favor.
I eventually had to become the likes of a Lawyer, studying all the Acts, to make sure they weren't running me up a gum tree.
But in one case, I won outright on two front's but, one that my useless Barrister didn't plead, using all my evidence on the 3rd aspect, which fell under trade and commerce = misleading and deceptive conduct.
Which would have meant, or deemed as, you would not have entered the contract, if you knew the other party was going to do what they did, before entering the contract = there would not be a contract in place = all moneys and costs returned.
But, the two areas that we won on, got overturned on an appeal.
The 3 judges acknowledged the carelessness of the Barrister for not pleading the trades and commerce, but to address it, meant that another case would have to start, some thousands of dollars later.
As we were down a Big one at this stage, we had to bail out.
Yep, money can turn people into animals and from people that you would least expect it from.
But I'll never give up, I come from a very Poor family, 8 kids (like the days of Noah lol), no power or running water etc, etc, etc until I was 16.
Pretty much worked two jobs all my life and all 8 of us, have done well, poorness made us.
And more importantly and it cost nothing, other than around 9yrs of passion and much pain (but it's not about me), I found either end of the Rainbow and you know what they say is there.
