The ASIC case against (from 1st link above), managing director Daniel McCarthy, chief commercial officer Nathan Boom, former chair Wallace King and former director and deputy chair Craig Ransley, are still ongoing.

On 27 May 2025, ASIC and TerraCom reached an agreement as part of a proposal to resolve the whistleblower victimisation claims that make up part of these proceedings. This proposal is subject to Court approval and will be considered by the Court. This proposal does not relate to ASIC’s allegations that Mr McCarthy, Mr Boom, Mr King and Mr Ransley failed to prevent false or misleading statements being made to ASX and breached their directors’ duties. These claims will be heard by the Court at trial commencing on 16 June 2025.
