    there is some rule about takeovers - have to offer a price that is at least the 4 month previous high.

    Check the ASIC rules on takeovers

    But yes someone could acquire shares to get them close to the mark and then make a move sometime in the future - but that would put them in the significant shareholder list first - haven't seen that occurring
