Toho could say tough luck. We won't accept the Nystar deal and won't increase our offer. Take it or leave it. They don't need their transactions to be approved for them to keep their stranglehold on the company. It is not as if either deal needs to proceed. My opinion. They can play hard ball as revealed in their revised offer letter.
