That's true if they have started the process. My argument assumes it hasn't started and they would be relying on positive publicly available information before triggering a process. Your statement would assume a scheme of arrangement. They would be obliged to announce this if ASX raises a query. Take-over announcements can be made with conditions.
As I said, lets see what happens....like a lot of people on this forum have speculated, the jump in price could be shorters responding to the rumors and closing their positions on the assumption that the rumours are true. If it turns out not to be the case, they will go back to shorting.
It shoul dbe fun watching this unfold this week...
