Hello Senaris, see the words below extracted from the Chairmans Explanatory Memorandum. It seems to me that FIRB will have to approve Mt Kellets the aquisition of 45% of LYC and if this approval is not forthcoming for reasons I have mentioned previously Mt Kellett will be prevented from acquring a controlling interest in LYC.
"that the Foreign Investment Review Board approve the issuance of the Warrants and the amendments to the Bonds and the issuance by the Company to the Bondholders of the shares issuable upon conversion of the Bonds and the exercise of the Warrants."
