– The court considers that the company’s application is complete and that the operation is permissible according to the Environmental Code. In connection with the environmental permit, the court also grants the company a Natura 2000 permit and an exemption from the species protection ordinance. We will familiarize ourselves with these conditions and what it means for the company and us as a supervisory authority, says Anna-Carin Ohlsson, head of the environmental protection unit.
Talga AB has received a Natura 2000 permit regarding the impact on the protected area Kalix and Torne river system. The Land and Environmental Court has also announced that the company has received an exemption from the species protection ordinance for three species of lupine that may be affected in the area. A total of 24 final conditions have been established for the permit. The conditions include necessary precautions and protective measures, among other things, regarding noise, blasting, reindeer husbandry, construction and finishing, as well as compensation measures for loss of natural values.
The County Administrative Board’s general attitude in the opinions has been that the activity should be permitted on the condition that conditions are prescribed for, among other things, discharges to water and restrictions on disturbances in the form of noise and dust.
The County Administrative Board has also raised the issue that sufficient financial security needs to be provided in order to guarantee that unwanted environmental consequences will not occur in the event of bankruptcy and has presented a basis for this assessment.
