The main point being, it's difficult to see there being anything new in the appeal that would have the potential to set a precedent. The Supreme Court judge who does the initial review will look for that. The lawyer's argument might be, well, we presented this evidence, but the court of appeal overlooked it. However, the original judge who granted the permit was "technically knowledgeable" in the area, so it is more likely that court of appeal agreed with her. Co-existence of the Sami and the mine is quite feasible.
