The only way the SOA is voted down is if Athos Capital has been coordinating with other large shareholders to block the deal or as part of a strategy to squeeze STX for a better deal. And if they were going to do this, I think we would have gotten wind of this. i.e. They would already have tried to negotiate with STX and would've been calling up other large shareholders to get to the 25% level. You can't do this without word getting around.
Furthermore, looking at Athos' track record, this is not part of their playbook. Their typical strategy is to short the acquiring company and buy the target company. In fact, they might be left high and dry with a large stake if the SOA fails. The immediate effect will be a collapse in TPD share price, and they will also need to repay the STX stock they have shorted (after SE3 results).
Put simply, I will be very surprised if Athos vote against the deal.

I really like STX and have plenty in there but I’m deadset against a stitch up. As others have pointed out the cash flow from Walyering could be a great springboard for other opportunities - but our weak CEO folded before the first hurdle.

if STX needed Walyering’s cash flow so badly they shouldn’t have farmed out. It’s like they feel they still own TPD’s share……..they can get stuffed!!!
