    Apologies for laughing but you have professional tax advice and you are asking a chat forum for their opinion?? You pay the guy to give you the right answer, even if it's not the answer you want. That's what they are supposed to do.

    FWIW, I agree with Dvyvan and your tax man. You made a profit so you pay tax.
