When the judge says "the defendent has a fiduciary responsibility to his company and shareholders to evaluate the land prior to finalising a deal" it kind of says it all.
Or when the date of the MZN announcement to market (11 Nov) was raised Justice Kenneth Martin says, "remembrance day".
I have 20 - 30 pages of notes from days 2 & 3 of the trial.
The biggest point for me is when it emerged that KDR wanted to announce an impending deal to the market in April and MZN did not due to their fear of being gazumped and not having a finalised deal in place.
7 months later they wanted KDR to move to a HoA ummediately.
Even the Judge said during his days in law school a HoA was only an agreement to agree!
However this case may become a new precedence for the future.
