Not sure if you are asking about this in general i.e. could you sue a company for this or start a class action for the purpose of making bank? If so then I'd recommend you ask the opinion of a lawyer who specialises in corporations law. To me (as a non-lawyer) the passage you quoted looks vaguely worded enough that I don't think it would succeed.

However if you're actually sincerely worried about having your vote counted specifically in the Shine AGM then I wouldn't worry about it. Why? Well that's because your votes (and my votes) don't matter. Have a look at page 160 of the annual report with the list of top 20 shareholders. Morrison and Roche own more than 50% of the company (note that they also control some votes that are not directly listed under their own names). As such they can do what they like regardless of how you or anyone else votes. The only way it would matter would be if Morrison and Roche voted against each other (i.e. disagreed) on a resolution and this isn't likely to happen.

The upside of this being that, owing so much stock, they have a strong personal interest in seeing strong Shareholder returns and to some degree their interests are aligned with ours. Though there are exceptions to this such as resolutions on their own remuneration packages.
