There are two separate issues.
Did the board and management cheat the customer(s)? You'd think the customer(s) would do their own checks. And if they were unhappy, they'd dispute things and/or stop taking product. If they found out long after the cheating, they would've sought a settlement or gone to court by now. Plus we're talking about back in the day when coal was well below $100/t. Maybe they can ask the state government for a refund of royalties too.
Did the board and management mislead the shareholders? That's for someone else to decide. But communication hasn't been a strong suit as long as I can remember.
