hey Alonso.... it the fault of the design of the legislation that is non-compliant with the constitution. it was the Lnp Govs that caused this, the court only finds according to law. it was contentious in 2004 according to Judge Gageler and is now decided. clearly the legislation needs a rewrite.
but lets face it, indefinite detention is contrary to law and human rights. what is needed for paedophiles is a life sentence. approx 90% of sex offenders re-offend, rapists in particular. the involvement of sex offenders in prison counselling and therapeutic interventions has an appallingly low effectiveness rate. insight is the key problem and these people, from my observation and psych studies, generally don't have the ability for insight.
