Worse yet, one in particular recently stated they "called the company and were told no CR before DFS".
Asking the company for market sensitive information... hmm
Legally dubious for BOD to answer that question with anything other than "Sorry I can't answer that..."
Even if the company is planning a CR, confirming so would be breaking the law, obviously, and they would NEVER confirm it even if they were planning it. NEVER, why even bother to ask.
Having said that, before DFS was the full answer - correct me if i'm wrong but that's just days away - but that no was used to set a narrative that one wasn't coming and nobody else called them out. hmm.
