If a company has made announcements to the market throughout the quarter in relation to a specific event and/or the progress of an action and there is no new information as at the end of the quarter, is the company required to include anything on that issue in their quarterly report?

There's no doubt that an adverse ruling would be material to VMC, as would a favourable ruling. I don't think that not including the litigation in the quarterly means that they're distancing themselves from the most likely outcome, as you say it does, rather, it looks to me that there was nothing new to add to the issue in the quarterly that hasn't already been announced separately and as the quarterly is a report to shareholders, well, the shareholders already know that information in any event.
