Contesting jurisdiction because the deal between Total and CTP was struck in Perth between CTP (headquartered in Perth at the time) and the subsidiary of Total (headquartered in Perth). It also places the burden on the court and the claimant to prove jurisdiction which can be quite hard to do. It can also challenge how long it took for the claim to be brought forward, which was a long time in this case.
