Your last sentence shows that we need to see the case in court. Are there any previous convictions? Are there any mitigating circumstances? There's a need for a judge here, not a mere cop. Cops might pull a car to the side and even take it into store but to confiscate it or smash it up, I think that's a bit rough. Questions need to be asked in front of a lawyer and judge.
