Having not litigated before, I am grappling with two things:
1. Is the % fee (for a class action) calculated on the return above what the liquidator gets us (if anything).
2. If we do nothing and a successful action is brought by others, why couldn't we (along with possibly several hundred other remaining Opes clients) just bring one subsequent class action to get the same outcome.
Whilst we would have to wait longer for the return, surely the fee would be far less, as the point has been proven. In this situation, ANZ may even settle with the rest of us and not take it to court???
I am just trying to cover all scenarios.....
