Unfortunately, BHP has an almost unlimited capacity to clog access every step of the way with a plethora of appeals, QC's and red tape. BHP will not be giving access away to anyone, and the "efficiency" of our court system will ensure that this process continues for many, many more years, even if this case is successful.

BHP has been at "full capacity" since the dawn of time, and even at the heights of the GFC it was at "full capacity" apparently. BRM's only hope is that the commercial benefits of BHP giving BRM access are so compelling that it overides any risk of precedent.

I'm starting to think that building a rail is not only the right option, but the only option. This might delay the project, but would give the potential for BRM to significantly expand its production and make full use of the 14km, 1 billion tonnes of 61% Fe it has.

The train drivers can then give each other the finger as they drive next to each other, but BRM holders can rest comfortable in the knowledge that not one cent of their revenue is going BHP's way. Something the Chinese will be smiling about too.
