Sativex contains equal amounts of THC and CBD derived from the plant; IRX 211, on the other hand, contains only synthetic THC.

Sativex, moreover, is also delivered sublingually.

You don't need to study Patent Law at Harvard to know Jazz Pharma cannot defend any patent they have for Sativex against 1. a different drug, 2. differently produced, and 3. is delivered to a different body organ.

It's a clearly distinguishable drug/combination device that contains no CBD, which new evidence suggests may cause less side effects:

“Overall, we saw stronger subjective drug effects, greater impairment of cognitive [thinking] and psychomotor [moving] ability and greater increase in heart rate when the same dose of THC was given in a high CBD cannabis extract, compared with a high THC extract with no CBD,” says Austin Zamarripa, Ph.D., a postdoctoral research fellow at the Johns Hopkins University School of Medicine and the study’s lead author.

It's all about prescriptions and medical insurance in developed countries. As a result, the big money will be in a drug that can be prescribed in America (18.1 million cancer survivors) and Sativex has no patent there.

If IRX 211 demonstrates it is safe and effective for BTcP, it has a compelling case for being prescribed by doctors as a fast acting opioid alternative pain relief medicine to improve and save lives.

It's very possible the company won't need to fund a phase 3 on its own if the phase 2 demonstrates IRX 211 can provide pain relief to cancer sufferers experiencing an episode of moderate to severe BTcP.
