AQ were/are in Afghanistan because the US set them up there. They were freedom fighters when they killed Russians.
When David Hicks was in Afghanistan the Taliban was the accepted govt of the country. He was apprehended in Kandahar trying to get out. No one claims he even took a shot at an American soldier.
