Hi luckyll,

Thank you for that post and your efforts concerning the letter to the ASIC.

You have my full support (and i guess that of many other small PIs)

I wonder for example why Batavia never publicly mentioned that they sold 2.5 Mio shares.

They had 30 Mio shares at one point,now they only own 27.5 Mio.

As i recall,it was someone from this board who discovered the fact by reading through Batavias quarterly financial statements from september 30th 2009.

I dont remember seeing anything made public on the ASX.

But as i can see from the latest Top20 shareholders(23.11.2009,only the Top3 would qualify for beeing a substantial holder:

No.1 are the combined oversea shares (meaning the german shareholders with 92 Mio shares or 20,5 % of the issued capital-so probably no big shareholder there.

No.2 are Citicorp Nominees with 75 mio shares or 16,5 %
Polos shares have to be among them.
So they qualify as a substantial holder.

No.3 is Batavia with 27.5 Mio shares or 6.1 %
They qualify as well.

No.4 Nefco Nominees "only" own about 18 Mio shares meaning 4 % of the company,so they are already too small to report...
