But KPMG's favourite phrase during the "submissions of objections" was:
"Where is the opposition to the settlement proposal?"
"Just one letter was received and was dealt with"
These 2 lines were repeated over and over again.
Just like I was repeating on the Forum: come with your objections, fill in section 7; don't leave it to the judge.
KPMG was milking these absences for all it was worth to them.
And "just 1 out of thousands of members" theme may become an entry in their training manual.
And it was painfully apparent to the judge, that the glaring void in objections file was just enough
to align his mind with those that have written a script for this pre-ordained outcome.
Yes folks, your absentee voices were truly deafening!
To be fair, the judge chucked out some morsels our way.
One was using the word "scam" regarding related party transactions.
Another was during musings about settlement proposal
"How do I explain what is reasonable”
Our feeble protestations about complexity of the Notice with 2 Dec deadline,
which caused the greatly reduced numbers of members opposing the settlement offer,
were just brushed aside.
The facts that...
1. the Notice itself was undated and many were received in staggered deliveries
2. Judge failed to call the "Objectors" to the bench at the BEGINNING of the session,
which would present a better opportunity to put our cases before him.
Instead, we were latched on as an afterthought (and at my request) and the nerves
were at their worst then. Though he apologised, the damage was done.
... did not help our depleted cause.
So in conclusion, I may suggest for us all to take the foot off the excitement accelerator;
there simply won't be similar excitements to come, as I see it on my horizon.
