    What every mineral right holder should do.
    One of the most controversial topics of 2010 for the local and international mining
    community has been security of tenure regarding mining and prospecting rights in South
    Africa.
    As part of the process to make the system more transparent, the Department of Mineral
    Resources (DMR) published a list of rights? holders and applicants on 1 September 2010.
    At the same time, the Minister declared a six-month moratorium on the issue of new
    prospecting rights.
    However, the published information is extraordinarily difficult to interpret as it is based on
    the DMR reference number and the corner points of the rights (input in different coordinate
    systems), and it is provided in a number of PDF documents.
    The Mineral Corporation has written an algorithm to unlock and interrogate the DMR
    database with regard to the acceptance, granting and issuing of title.
    The ability to interpret the contents of the database has demonstrated that there are
    material anomalies. The evidence suggests that no holder of prospecting rights in South
    Africa should be confident or complacent regarding their mineral title unless they have fully
    interrogated the database which is now in the public domain.
    The Mineral Corporation recommends that companies ensure that they have diligently
    examined and confirmed the status of their rights. To assist in this regard, The Mineral
    Corporation offers a service that is able to identify the following information for each
    property:
    1. The holder of the right;
    2. Applications that are in the midst of being processed; and
    3. Applications which were either refused or rejected.
    The data also provides the following key information:
    1. Validation that the right applied for has been processed;
    2. Any potential conflict or overlap with rights accepted, granted or issued to other
    parties;

    3. Other parties that applied (successfully or unsuccessfully) for the same property;
    4. The date of your application (and of other parties? applications); and
    5. Parties that hold neighbouring rights.
    Our independent service aims to provide an element of confidence that your mineral right
    tenure is secure and to highlight the relevant issues such as competing applications, status
    of application and area of application.
    The Mineral Corporation?s interrogation has uncovered areas where two or more rights
    have been granted to different parties over the same property. In one instance, it was
    discovered that our client held the correct documentation pertaining to a property (thereby
    suggesting apparent validity) but the rights were not listed on the DMR database.
    We believe that this is an essential service for any mining group, exploration company or
    entrepreneur in these times of mineral right uncertainties.
    The guarantee of tenure in the mining and exploration business is a fundamental right and,
    if such rights are jeopardised, the financial implications to the holder of such rights could
    be enormous.
