It is very unlikey that this Opes Prime matter is going to see the light of a courtroom, so for those thinking you will get 100c plus damages awarded by a judge you are dreaming.
ANZ/ML want to settle and they have show their hands to do so with a little help from ASIC.
Any litigator will need to get more than 70c as an offer to get more than the current offer as they will take 30c. So you may wait another 2 years and it settles on the court steps at 80c as at 27th March. Take 30c off any offer and you are up a stagering 10c and perhaps lost more friends and family along the way.
It is obvious that cracks are showing in some OP clients now, so you would want to have some real resolve to go the extra distance and take the extra risks.
Unless the litigators can cap their fees or lower them for settlement or guarantee this case goes the whole way, it is not worth the effort.
Again, each creditors needs to determine what is in their best interests not just financially, life is short and time cannot be purchased.
