Surely the question is, given assertions by others, whether I have any references saying that NAMA is maintaining the pit. I don't. NAMA has not replied to me.
That Wiki reference you posted is useful. You say it defines maintenance of a mine as the undertaking of certain duties. What are those certain duties?

"While the mine is closed, a care and maintenance program will manage environmental risks associated with tailings dumps, hazardous materials and open and underground pits."
So is NAMO doing this? I don't know, but I hope they are.
