Discovery is a required process in civil court proceedings, where parties require production of material to prove or disprove their case. Once discovery is complete, the court requires both sides produce identical and corresponding material to each other. It is then generally not permissable to introduce argument or evidence adduced outside the provided documents without permission of the court. This ensures that both parties understand the details of the case, avoid any surprises at the trial and encourage a settlement before the trial. It appears that Discovery is complete, so now the court orders the parties to make the material available to each other so they are on the same page.

The court is further ordering ASIC to make a Statement of Claim, provide the defendants with all material it seeks to rely upon, and to have the defendant plead each charge.
