Yes I too would rate it as more likely but far from settled. The Concourt does have a degree of authority over others, however, it has not specifically ruled on who are the real reps. Judges can only rule on what they're presented in court. They don't generally go out of their way to ask questions about other issues. Lawyers will try to use angles that they are fairly certain they can win.

It should now be up to the DMR to determine who. Perhaps both teams are unsure of who would be given representation rights if that was the issue - maybe that's why it was not pushed as the primary issue in the courts.
