At least one of the suits has a plaintiff, but unless they get two more plaintiffs to join them it cannot be considered a class action. What will likely happen is that three firms will each get a lead and then they argue who is the lead and consolidate into one case, creating a class action. If you read the basis for these cases, they all clearly pulled information from the first fishing expedition and then add their own twist to the news. Unilife if they were getting some good advice should have put out this statement in the US when it first happened. That would have mitigated the immediate slamming of the stock on the ASX and probably would have stemmed the decline on the US market. The whole notion that all these deals are delayed because of this is just an excuse. Maybe it would take two or three weeks, but since these allegations are the same as the other crud spewed by the whistleblower suit and the forbes article, big companies will see right through that and proceed. My gut tells me since these delay have happened time and again there is some sort of disconnect between AS and the Sales Team or the Sales Team and the customer. The time for sales is now. How long will the market support an R&D factory?
