    ...by the Labor Party that discretionary trusts are being used to avoid tax.

    Trusts MUST have a primary purpose other than a that of reducing tax. If they have NO other primary PURPOSE but reduce taxes, then that trust no longer is a tax avoidance vehicle , it is a tax evasion vehicle.

    Isn't this the law?

    If there isn't a tax ruling on this, then there is meant to be!

    Can anyone cite the case? 'not capable of explanation by reference to ordinary business or family dealing ' The Doctors' Cases? COT v Gulland, Pincus V FCT , Watson V FCT

    With this precedent, why does Shorten need to mouth his smarmy mouth off?

    "We need a new law?" Says he...

    "But there is already a perfectly good one in place sir!"
