Any parent is free to sue doctors, hospitals, health departments, and the government for negligence and have it taken to the High Court. Throw enough cash at a lawyer and go for it.
You may have trouble finding a lawyer....not because of intimidation (lawyers are quite adept at standing up for themselves and others, that's what they are paid to do), but professional ridicule for intentionally taking on an unwinnable case. Good for the pockets of the lawyer at the time, not good for the long term reputation.
