The reason Conroy offered an ultimatum rather than simply declaring a structural separation, is that there are concerns about the legality of a government dealing with private property in such a cavalier manner.
If you read Telstras response, it is very measured. Rather than conceding to the 'demands', the company essentially said 'we will think about it'.
This thing is far from over. There is a lot of water to flow under the bridge before anything is likely to happen, and without the Govt offering a significant 'bone' for the separation, we may see any legislation caught up in court for some time (thats assuming it gets passed in the first place).
As an aside, did anyone else get the feeling that Conroy is a pompous bully? It is a bit of a shame old Sol isnt still around. He would have told Conroy just where he thought he should go
