The corporations law doesn't allow companies to discriminate between shareholders. The extent of the application of the law in relation to capital raisings has never really been tested to my knowledge.
For example with AAX they scaled back anyone holding less than 500 shares. i.e. effectively discriminating against smaller holders (althought obviously targetted at speculators)
