It is such a simple thing to interpret.
Either Bowler could only apply the Public Interest test to Cazaly's tenement application as it relates to the land (Shovelanna) or he could apply the test to ANYTHING that Bowler is capable of imagining that relates to Shovelanna according to his mind.
If the later, then he could relate it to even an extinguished exploration Licence “RIGHT” (which by comparison, Australia Aboriginals are perpetually denied, should an attachment to the land become extinguished).
Or Bowler could have denied anyone a tenement application (eg: CAZ), in preference to the likes of say BHP or RIO, who happen to be second in line (in time, application wise). Because?
Because Bowler decided it was in the public interest to allow BHP/RIO preferential treatment over a Minnoe like Cazaly because BHP/RIO (which are big and have existing large port facilities) needs more! More iron ore!! More! More! More, Iron Ore!
