No, that's not what I'm suggesting at all. What I'm suggesting is that if AGS is successful in the current court case, the judge will have to assess damages. I.e what does the 10% apply to? In those circumstances, AGS in its submissions may well argue that it applies to the entire ML & Quasar will argue it only applies to a small section. I.e the opposite of their current positions.

Anyhoo, just spent some time reading about Joe Hockey's defamation case against Fairfax. Media seem to be lapping it up. Which got me to thinking maybe someone here should prepare some briefing notes for the media? I think FO has been in contact with some journalists? Could be a very interesting court case for the media.
